Terms and Conditions of the PreverSi Service
1.1. These Terms and Conditions define the rules for using the "PreverSi" online service (hereinafter: the "Service").
1.2. The operator of the Service and the entity providing electronic services is HQ Market sp. z o.o., ul. Frezerów 3, 20-209 Lublin, Poland, Polish Tax Identification Number / NIP: 9462684492 (hereinafter: "Service Operator" or "Service Owner"). The "PreverSi" service is part of a project developed in cooperation with PB Vision iT.
1.3. The controller of personal data is HQ Market sp. z o.o., ul. Frezerów 3, 20-209 Lublin, Polish Tax Identification Number / NIP: 9462684492 (hereinafter: "Data Controller").
1.4. Contact regarding personal data:
1.5. General contact:
1.6. By using the Service, the user accepts these Terms and Conditions.
2.1. PreverSi is part of an international system operating in different countries under different names and language versions, developed in cooperation with PB Vision iT.
2.2. The system uses analytical tools, including automated data processing, for comparing information entered by users.
2.3. The system may indicate potential connections between reports concerning the same persons or entities and inform users about matching results.
2.4. Results generated by the system are for informational purposes only and do not constitute confirmation of accuracy or any legal or factual assessment.
2.5. Where potential connections are identified, the Service may allow users — with mutual consent — to establish contact through the Service.
2.6. The Service may enable user cooperation solely at their own initiative and responsibility.
3.1. Use of the Service requires registration of a user account. Selected features are available free of charge within a Free account. Viewing detailed search results and publishing an entry may require active paid access or a one-time payment according to the current pricing.
3.2. A Free account allows the user to use the account dashboard, start a search, create and save draft entries, and enable record monitoring.
3.3. A Free account user does not see detailed search results, the number of results, or information on whether the searched person or entity is present in the database. This information is available only after activating the relevant access.
3.4. Users must provide accurate and truthful information.
3.5. Sharing accounts with third parties is prohibited.
3.6. Users are responsible for all actions performed through their accounts.
3.7. The Service is intended for persons aged 18 and over.
4.1. Some features of PreverSi are paid. The current price, scope and access period are shown to the user before payment.
4.2. Before completing the payment, the user may be asked to expressly consent to the commencement of the digital service before the expiry of the statutory withdrawal period and to acknowledge the loss of the right of withdrawal to the extent provided by applicable law.
4.3. Payments are processed via external payment operators (e.g. Stripe).
4.4. If the user purchases a service marked as a monthly subscription, the subscription may renew automatically for each subsequent billing period until cancelled. The user may cancel the subscription through a function available in the user account. Cancellation stops future automatic renewal and does not in itself entitle the user to a refund for an already started or paid period; this does not affect statutory consumer rights.
5.1. A consumer who concludes a distance contract has the right to withdraw from the contract within the period set by applicable law, generally 14 days from conclusion of the contract for a service contract.
5.2. If the consumer requests that the paid service begin before the expiry of the withdrawal period, the Operator may require their express consent to the commencement of the service before the expiry of that period.
5.3. If the consumer withdraws after the service began at their express request before the expiry of the withdrawal period, they may be required to pay for the performance actually provided until withdrawal, where applicable law so provides.
5.4. Where applicable law requires an online withdrawal function, the Operator will ensure it is easily accessible in the online interface during the statutory withdrawal period, and it may be labelled e.g. "Withdraw from the contract here".
5.5. This section applies only to users who qualify as consumers under applicable law.
6.1. Search automatically covers all relevant areas of the PreverSi database. The user does not need to select an individual catalog when searching or purchasing access.
6.2. A Free account user may enter a search query but, without the relevant permission, will not see the results or information on their existence.
6.3. The Service may allow the user to enable monitoring of records that may concern their data. A notification of a potential match does not confirm identity, the truthfulness of a record, or any legal or factual assessment.
7.1. Users may create entries concerning persons, sole traders, companies or other entities within the available functionality.
7.2. A user may first save an entry as a draft. A draft is not a published entry, is not available to other users, does not appear in search results, and is available only to its author and to the Operator to the extent necessary for the technical operation and security of the Service.
7.3. When creating an entry, the user may select its topic. The topic serves only for organisational and thematic classification and is not a separate paid database.
7.4. Publishing an entry may require active publishing permission or a one-time payment according to the current pricing. If the user lacks the required permission, they may be redirected to payment and, after a successful payment, complete publication of the created draft.
7.5. After publication, an entry may be made available to Service users according to the current access rules. Publication does not necessarily mean free access for the entire public without registration or the relevant permission.
8.1. PreverSi may allow the user to choose whether their identity is shown next to the entry to other authorised users.
8.2. The user may be able to publish an entry without displaying their identity to other users.
8.3. Publication without displaying the author's identity does not mean anonymity towards the Operator. The Operator may continue to process the author's account data, technical data and other information necessary to secure the Service, moderate content, prevent misuse, handle reports, protect the rights of data subjects and comply with legal obligations.
9.1. Users are responsible for the content they create or publish through the Service.
9.2. Users may publish only information that is, to the best of their knowledge, true, related to a real experience, event or relationship, appropriate to the purpose of the Service, and does not infringe the law or third-party rights.
9.3. It is prohibited to publish, in particular, content that is knowingly false or misleading, defamatory, offensive or threatening, used for harassment, revenge, blackmail or coercion, unlawfully infringes another person's personality rights, contains special categories of personal data under Article 9 GDPR without a legal basis, contains excessive personal data, passwords or payment data, or otherwise breaches applicable law.
9.4. Users must not use the Service for systematic stalking, discrimination, unlawful profiling or other misuse of information about persons.
9.5. The Operator provides a technical platform and is not the author of user-created entries.
10.1. An entry may be added to the database after publication without prior individual review.
10.2. The Operator reserves the right to subsequently review or moderate content, and may restrict availability, temporarily hide or mark an entry as disputed, request an explanation, remove an entry, or restrict or block an account.
10.3. A user or other affected person may report problematic or potentially unlawful content via the relevant Service function or at:
10.4. A report should allow the relevant content to be clearly identified and explain why the reporting party considers it unlawful or in breach of the Service rules. Upon sufficiently credible information about potentially unlawful content, the Operator may promptly restrict its availability during review. The Operator is not obliged to carry out general monitoring of all stored information unless the law provides otherwise.
11.1. The Operator may temporarily restrict or block a user account, in particular where the user repeatedly breaches these Terms, publishes unlawful content, intentionally provides false data, misuses the Service, unlawfully obtains or discloses data, circumvents payment or security mechanisms, attempts automated harvesting of the database without consent, or uses the Service in a way that may harm other users or system security.
11.2. When deciding on account restrictions, the Operator may take into account the seriousness, frequency and consequences of the breach.
12.1. A user may submit a complaint regarding the operation or a paid service of PreverSi at:
12.2. A complaint should include data identifying the user or account, a description of the problem, any payment identifier, and other information needed to assess it.
12.3. The Operator will handle the complaint without undue delay and within the period set by applicable law.
12.4. A consumer's mandatory statutory rights arising from liability for defects of a service or digital content are not limited by these Terms.
13.1. If a consumer is not satisfied with how the Operator handled their complaint, they may, under the conditions set by law, use alternative resolution of the consumer dispute.
13.2. Information on alternative dispute resolution in Slovakia is available in particular through the Slovak Trade Inspection (SOI) and the list of competent ADR entities.
13.3. Using alternative dispute resolution does not exclude the right to pursue claims before the competent court.
14.1. The Operator is not the author of user-created content.
14.2. The Operator does not guarantee that every entry published by a user is true, complete or up to date.
14.3. Information obtained through PreverSi should not be the sole basis for a significant employment, business, financial, rental, legal or similar decision. The user should independently verify information and consider other relevant sources for significant decisions.
14.4. The Operator is not liable for decisions made by users solely on the basis of content created by other users, unless mandatory law provides otherwise.
14.5. The Operator may temporarily restrict availability of the Service due to maintenance, updates, a security incident, a technical fault, or circumstances beyond its reasonable control.
14.6. Nothing in these Terms excludes or limits the Operator's liability to the extent it cannot be excluded or limited under applicable law.
15.1. Personal data is processed in accordance with applicable law, including Regulation (EU) 2016/679 (GDPR).
15.2. Detailed information is set out in the Privacy Policy.
15.3. Requests regarding personal data may be sent to:
15.4. GDPR rights may also be exercised by a person who does not have a PreverSi account, where the Service processes their personal data.
16.1. The Operator may develop, change or extend the Service with new features.
16.2. The Operator may amend these Terms, in particular due to changes in law, the operation of the Service, new features, changes to the payment model, or security, technical or organisational changes.
16.3. Users will be informed of material changes affecting an existing contractual relationship in an appropriate manner, e.g. through the user account or by e-mail.
16.4. A change to the Terms may not deprive the user of rights acquired under mandatory law before the change took effect.
17.1. In connection with the further development of the project, organisational changes, restructuring or transfer of the project, the entity operating the Service may change.
17.2. If such a change affects users' rights or obligations, users will be informed to the extent required by applicable law.
17.3. Any transfer of personal data to a new operator or controller may take place only in accordance with the GDPR and other applicable law.
18.1. Legal relations not regulated by these Terms are governed by applicable law.
18.2. Where the user acts as a consumer, all rights granted by mandatory law of the European Union and the state of their habitual residence are preserved.
18.3. If any provision of these Terms is invalid or unenforceable, the validity of the remaining provisions is not affected.
18.4. The current version of the Terms is available at https://preversi.sk/terms.
